Prices

The prices of goods are referred to in our price-list and the specifications detailed in our catalogue or outline drawings.
The place of delivery is our factory (Ex.work), unless otherwise agreed.
All packing material requires additional charge.
Present or future taxes are not included.
If for any reason the Purchaser requested any variation after placing the order, Tope S.A. reserves the right to revise the price.
Any special test will be charged to the Purchaser.
Some prices may not be included in our price-list; in such a case, contact our Sales Department.
Price-list and delivery time for standard goods can be altered without previous notice.

Delivery conditions

There is a minimal order value of 120.00 € for special products.
All prices for special products are based upon the Purchaser’s acceptance of over runs and under runs, not to exceed 3 % of the quantity ordered.

Term of sonditions of sale according quantity

On orders for products carried in stock, Tope will deliver the ordered quantity specified. However, in the manufacture of products it is agreed that Tope will be allowed production losses. Tope shall have the right to manufacture, deliver and invoice for partial deliveries of products as stated below:

1-6 units no variation
7-24 units ± 1 unit
25-74 units ± 2 units
? 75 units ± 3%

Tope will deliver exact quantities on products with a net price of 100.00 € or more. If buyer expressly requests no variation in delivered quantity of products with a total net price under 100.00 €, a ten percent (10%) surcharge will be added to the net billing on the invoice for such order.

Payment terms

Prices are given for cash payment.
Payment after 90 days, will be increased 3.2 %.
Payment after 60 days will be increased 1.6 %.
Orders up to 120.00 € shall be accepted only in cash, on delivery.
Special orders will be paid 50 % in advance.
Claims received by written notification do not allow Purchaser to stop or delay the payment nor to reduce it.
It is expressly agreed by the parties that property certificate of the products supplied in accordance with the terms will remain property of Tope S.A.
until total payment is received.

Warranty

Resistencias Tope, S.A., guarantees its products against all manufacturing defects for a period of one year from the date of supply.
If a defect occurs within this period, Tope S.A. will replace or repair the defective part providing it has been used according to its specifications. This warranty is not applicable to any use in applications or conditions different from those required.
Tope S.A. shall in no event be liable for the faults caused during use, when the elements heaters are used in corrosive fluids.
Long storage or inactivity may temporally reduce resistance to moisture.

Returns

No returns will be accepted without the written agreement of the Tope S. A TECHNICAL AND COMMERCIAL SERVICE:
Tope S.A. Shall in no event be liable for the freight charges and will accept a return only after agreement by our Sales Department. Purchaser must send the warranty card and a copy of the bill. After our WARRANTY SERVICE has inspected the element, it will be repaired or replaced if required. This warranty is not applicable to manipulated, misused or mechanically damaged elements. Those elements will be at the customer’s disposal for 30 days; afterwards they will be destroyed.
In case of acceptance, the payment of any standard material returned will not exceed 90 % of the invoiced material (excluding package).
This amount will be deducted from new orders.

Liability

Tope S. A. is not responsible for accidents or incidents related to the use of its products, such as hurt persons, damages, economical or financial consequences.
The maximum liability will not exceed the total price invoiced.

Law

All controversy and contracts to which these conditions apply take effect according to the Spanish Law.
